                          DEFRAUDING BY FALSE PRETENCE CONTRARY TO SECTION 131 OF ACT 29/30
                          PARTICULARS OF OFFENCE

HARRY DJORGEE: a legal practitioner for that you in the month of may, 2010 at Tema in the Tema metropoly and within the jurisdiction of the, with intent to defraud obtain the consent of DR. DAVID KUPUALOR to part with cash the sum of $4, 000, 00 by means of certain false pretence to wit by false pretending that if the said amount is given to you, you could secure him a Canadian residential permit and upon such false presentation you succeeded in obtaining the said amount from the said DR.DAVID KUPUALOR a statement which you well knew at the time of making it to be false and arrested in 04/04/13.cd in the sum of     GHC 8000,00 with 2 sureties.

                Brief facts: complainant in this is a medical officer working with ST.John of God hospital at Sefwi Asafo in the western region and currently with Okomfo Anokye teaching hospital Kumasi whilst accused person Henry is legal practitioner residing at Tema community ten. During the month of May, 2010, the complainant needed t Canadian immigration resident permit to enable him to travel to Canada for further educational studies. The complainant approaches one Emmanuel Ekow Arhin who in turn introduced him to accused as the one who can assist him realize his dream. Accused charged a total amount of $4,000,00 as processing tree with the assurance that the documents will be ready by September,2010 complainant paid the said amount on 31st may,2010. After collecting the money accused failed to secure the documents. All efforts made by the complainant to get his money back. Also proved futile. On the 04/09/2012 complainant reported the case to community one police. He was arrested and cautioned. After investigations accused was charged with the offence and arraigned before the honourable court of Tema.

The intensity at which micro finance companies in Ghana are experiencing serious financial challenges has called for reviewing portions of the regulations covering the micro finance sector to deal with bankruptcy reports in the sector. In an interview with Pravda business news Chief Executive Officer of universal micro finance institute Kofi Amofah Fofie urged authorities of the banking sector to strengthen the already existing policy? The Bank of Ghana is reviewing portions of the regulations covering the micro finance sector. Key among this is the 100 thousand minimum capital requirements for micro-finance companies which are to be increased.
 Meanwhile a financial consultant Kojo Akpabi says tightening regulations at the micro finance sector will prevent traders from accessing it.
